2. Scope
These General Terms and Conditions (Terms) govern the use of Rent A Gym's premises, facilities and services.
By booking a session, the customer confirms that they have read, understood and accepted these Terms.
Approved coaches are also subject to the special coach terms in section 33. These must be expressly accepted before each initial publication or republication of the coach profile. Each gym slot is subject to the terms accepted when it was booked; subsequent changes do not retrospectively alter existing bookings.
3. Services
Rent A Gym is an unstaffed fitness studio offering training sessions of a fixed duration.
The following session types are available:
Private Session
Exclusive use of the entire gym
Maximum occupancy: 6 people training; for approved coaching, one additional coach as set out in section 20.
Duration: 90 minutes
Shared Session
Shared use with other customers
Maximum total occupancy: 6 people training; for approved coaching, one additional coach as set out in section 20.
Every person training requires a valid booked place. For approved coaching, the coach books their customers' places in accordance with section 33. Shared use by Plan H Physio, as provided for in section 20, is excepted.
Duration: 90 minutes
Groups of more than 6 people require a prior individual agreement with Rent A Gym.
4. Formation of the contract
The contract is formed upon successful booking and receipt of payment in full.
Rent A Gym reserves the right to reject or cancel bookings without stating reasons.
5. Prices and payment terms
The prices published at the time of booking apply.
Accepted payment methods:
Visa
Mastercard
Apple Pay
Google Pay
All prices are in Swiss francs (CHF).
6. Bookings, cancellations and refunds
Bookings are binding.
As a rule, cancellations, rescheduling and refunds are excluded.
In justified exceptional cases, particularly illness or accident, Rent A Gym may, at its own discretion and upon presentation of a medical certificate, grant rescheduling, credit or a refund.
There is no entitlement to this.
For cancellation of a gym slot booked by a coach due to a customer's illness or accident, the special voucher arrangement in section 33 takes precedence. Mandatory statutory rights remain reserved.
If a booked session cannot be used due to a proven fault in the access system and Rent A Gym could not be reached during the booked session despite reasonable attempts to contact us, the customer will receive a full refund or, at their request, an equivalent replacement session.
Further claims are excluded.
Refunds due to technical faults are granted only where it can be demonstrated that the booked session could not be used.
Technical problems must be reported immediately during the booked session.
No refund is available if the session could be used in full or in part despite technical faults.
7. Access and door codes
After a successful booking, the customer receives an access code.
The access code works only during the booked session and automatically expires afterwards.
Entry before the booked session starts is not permitted.
Late arrival does not entitle the customer to an extension or a change of session time.
Rent A Gym must be contacted immediately if there are problems with the access system.
Rent A Gym endeavours to provide support as quickly as possible, but cannot guarantee immediate assistance at all times.
8. Access rules for Shared Sessions
For Shared Sessions, the access code is personal and non-transferable.
Sharing the access code with third parties is prohibited. An exception applies to confidential sharing by an approved coach with the customer booked for that specific Shared Session in accordance with section 33.
Every person training requires a valid booked place; for approved coaching, the coach books the customer's place. The approved coach does not require a separate training place. Shared use by Plan H Physio is governed by section 20.
9. Access rules for Private Sessions
For a Private Session, the access code may be shared with the participants in the booked session.
The person making the booking is the responsible lead person for the session and must be present throughout the use of the gym.
The person making the booking undertakes to inform all participants of the applicable Terms, house rules and safety regulations.
The maximum of 6 people training must not be exceeded. A coach approved under section 20 does not count towards these six training places.
The person making the booking is responsible for ensuring that all participants comply with the Terms and house rules.
Breaches of the Terms or house rules by participants may be attributed to the person who made the booking.
If a participant causes damage and cannot be identified, Rent A Gym is entitled to contact the person who made the booking for the handling of the claim.
10. Misuse of the access system
The following are specifically prohibited:
Sharing a Shared Session access code with third parties outside the expressly permitted sharing by a coach under section 33
Using the gym without a valid booking, except for shared use by Plan H Physio as provided for in section 20
Exceeding the maximum permitted number of people
Tampering with the access system
Misusing technical equipment
Bypassing the booking system
In the event of a breach, Rent A Gym may impose a contractual penalty of CHF 500 per incident.
Claims for damages are expressly reserved in addition.
Rent A Gym may exclude the persons concerned from further use with immediate effect.
Payments already made will not be refunded.
11. Age requirements
Use of the gym is permitted for persons aged 18 and over.
Young people aged 16 or 17 may use the gym only with written consent from a parent or legal guardian.
Rent A Gym may request proof of this at any time.
Persons under 16 may not use the gym.
12. Health and personal responsibility
All facilities are used at the user's own risk.
By booking, each user confirms that they are physically and medically fit to use the available training facilities safely.
Anyone with health concerns or uncertainty is advised to seek medical advice before use.
Rent A Gym does not carry out medical or health checks.
13. Liability
Rent A Gym's liability is excluded to the extent permitted by law.
Liability for unlawful intent or gross negligence remains reserved.
In particular, Rent A Gym is not liable for:
Training accidents
Injuries
Health problems
Overexertion
Theft
Loss of personal belongings
Damage to personal belongings
Technical faults
Power outages
Internet outages
Business interruptions
Force majeure
All equipment is used at the user's own responsibility.
14. Equipment and safety
All equipment may be used only for its intended purpose.
Safety devices, safeguards and technical installations must not be removed or tampered with.
Exercises with an increased risk of injury are performed at the user's own responsibility.
Users must leave equipment in proper condition after use.
15. Damage and compensation
Customers undertake to treat all facilities, equipment and premises with care.
Anyone who intentionally or negligently causes damage is fully liable for it.
Anyone who damages, destroys or renders unusable any facilities, equipment, furnishings, access systems or other parts of the gym is liable for all repair, replacement, downtime and consequential costs.
Rent A Gym expressly reserves the right to pursue further claims for damages and to file a criminal complaint.
16. Duration of use
The booked session ends at the booked time.
Everyone must have left the gym by the end of the session at the latest.

Any mess must be cleaned up immediately.

Read the Gym Rules before your visit ↗18. Cleaning costs
Exceptional cleaning required due to excessive soiling may be charged to the person responsible according to the work involved, with a minimum charge of CHF 100.
19. Music
The gym's sound system may be used through the app only during a Private Session. It is not available during Shared Sessions.
The sound system's volume is deliberately regulated to limit noise. This regulation must not be bypassed.
Personal speakers and sound systems must not be used because of noise disturbance.
Rent A Gym may take appropriate measures in the event of repeated breaches.
20. Coaching, personal training and cooperation with Plan H Physio
Personal coaching and personal training in the gym are permitted only with Rent A Gym's prior express consent. Without this consent, they are not permitted in either Shared or Private Sessions.
Booking a session does not in itself authorise anyone to offer or deliver personal coaching or personal training in the gym. Interested customers can request coaching through our coaching page. Coaches must agree a collaboration with Rent A Gym in advance; submitting a request or application does not constitute consent.
For approved coaching, the coach does not count towards the maximum of six people training and does not need a separate training place. Only one-to-one coaching is permitted in a Shared Session: the customer occupies one of the six training places. Up to five other people may train as usual. Only one coaching session may take place in the gym at any time, irrespective of the coach; this also applies to overlapping sessions.
Approved coaching in a Private Session is possible with one to six customers plus one coach. Group coaching with two to six customers is permitted only in a Private Session; the entire gym is reserved exclusively for this purpose.
For coaching requests with a preferred time, the requested time must be at least 72 hours and no more than four weeks ahead when submitted. A regular request for a time offered by the coach reserves one training place for Shared or the entire gym for Private, as well as the coaching place, for 24 hours from submission. The reservation is released if the coach declines or the deadline passes. Individual requests do not reserve a place, even if a preferred date is provided. Availability is checked again when booking. Any payment already in progress is reconciled before releasing the slot. Neither a request nor a reservation is a confirmed booking or payment confirmation. Submitting a new regular requested time starts a new 24-hour reservation period.
The rules governing coach profiles, gym prices, customer payments, access, responsibility and cancellation with a medical certificate are set out in section 33. Coaches may also book available slots at short notice and up to four weeks ahead without a prior customer request; the 72-hour notice period applies only to customer requests.
Compliance with all legal requirements is the responsibility of the trainers.
Rent A Gym cooperates with Plan H Physio (Hielke), the physiotherapy practice next door. Under this cooperation, Plan H Physio may share use of the gym with its own customers without a regular session booking. The gym is not shared during a Private Session.
This shared use is excluded during a Private Session and is permitted only if no more than four people are present in the gym before entry. Including the treating practitioner and their customers, no more than six people may ever be present in the gym during this shared use.
Plan H Physio must take occupancy into account before and during shared use. Booked sessions take priority. Shared use must end in good time if the maximum of six people would otherwise be exceeded, and at the latest before a Private Session begins.
21. Company and group bookings
Companies may book the gym.
Groups of more than 6 people must submit an individual request in advance.
Groups are generally advised to book a Private Session.
22. Photography and video recording
Photography and video recording are generally permitted.
The personal rights of other people must be respected at all times.
People must not be recorded in an identifiable way or have such recordings published without their express consent.
Users are responsible for complying with all data protection and personal rights provisions.
23. Video surveillance
The gym is monitored by video for the safety of people, premises and equipment.
Recordings are used exclusively for security purposes.
Recordings are generally stored for a maximum of 14 days and then automatically deleted, unless statutory retention obligations or legitimate grounds require longer storage.
Rent A Gym is entitled to review video recordings, access logs and booking data where necessary to investigate damage, misuse, breaches of contract or criminal offences.
24. Emergencies
An emergency kit is available in the gym.
In a medical emergency, the appropriate emergency service must be alerted immediately.
Rent A Gym can also be contacted at the following phone number:
The availability of an emergency kit does not replace medical care.
25. Fire safety and safety equipment
Escape routes, emergency exits, fire extinguishers and technical safety equipment must not be obstructed or tampered with.
All safety instructions must be followed.
26. Misuse of emergency equipment
Misusing emergency equipment or deliberately triggering false alarms is prohibited.
All resulting costs will be charged in full to the person responsible.
Further claims for damages remain reserved.
27. Exclusion from use
Rent A Gym may exclude persons from use at any time for breaches of these Terms or the house rules.
Payments already made will not be refunded.
28. Data protection
Personal data is processed in accordance with the applicable provisions of the Swiss Federal Act on Data Protection (FADP).
Further information is provided in Rent A Gym's separate privacy policy.
29. Changes to the Terms
Rent A Gym may amend these Terms at any time.
The version in force at the time of booking is authoritative.
30. Severability
If any provision of these Terms is or becomes wholly or partly invalid or unenforceable, the validity of the remaining provisions is unaffected.
31. Applicable law and jurisdiction
Swiss law applies exclusively.
To the extent permitted by law, the place of jurisdiction is Davos, Switzerland. Mandatory statutory places of jurisdiction, particularly for consumers, remain reserved.
32. Multi-session passes: validity and reactivation
Multi-session passes are valid for one year from the date of the first confirmed session paid for with the pass. The training date, rather than the date the booking is made, is decisive. Purchasing a pass or accepting a gift pass does not start its validity period. The precise expiry date is shown in the member area. Individually issued passes are subject to the expressly agreed validity dates.
After expiry, no further sessions can initially be booked with the pass. Remaining entries are not deleted as a result.
Expired multi-session passes with remaining credit can be reactivated free of charge on request. The request must reach rentagymdavos@gmail.com within five years of the date of the first confirmed session with that pass. Please identify the pass and your member account.
Reactivation preserves the remaining entries. The pass is reactivated for a further year from reactivation. Within the stated five-year period, reactivation may be requested again if the pass expires once more. The five-year period applies to receipt of the request; it does not shorten a new validity period already granted.
Mandatory statutory rights and limitation rules remain unaffected. This arrangement does not shorten any mandatorily applicable statutory periods.
33. Special terms for coaches
Approval and publication: Coaching is permitted only with Rent A Gym's express approval. Approval is personal and must not be transferred to other trainers. Before each publication or republication, the signed-in coach actively accepts the entire Terms, including these coach terms. Rent A Gym records the member identifier, time, Terms version and profile version in the existing coach record. Publication itself is free and does not create a slot booking.
Separate contractual relationships: The coach books use of the gym in their own name and pays Rent A Gym the displayed gym price. The coach and customer agree and settle the coaching service separately and directly with each other. Rent A Gym is neither the provider nor the payment recipient for the coaching service and guarantees neither training results nor payment by the customer. Rent A Gym's own responsibility for the agreed use of the gym and mandatory statutory liability remain unaffected.
Gym prices per 90 minutes: Shared with one customer costs CHF 50. Private costs CHF 110 with one customer, CHF 120 with two, CHF 130 with three, CHF 140 with four, CHF 150 with five and CHF 160 with six customers. The coach is not included in the customer count. The total price displayed before completion of the respective booking is authoritative. Changes do not apply retrospectively to confirmed bookings.
Coaching prices and customer information: Before an agreement is made, the coach provides the customer with a transparent total coaching price, the scope of services and their payment and cancellation terms. The coaching prices displayed in an offer are total prices for the selected session and number of customers, not supplements per person. The coach handles invoices, payment problems, complaints and any refunds for their coaching service themselves. The gym price remains payable regardless of whether the customer pays the coach or attends the appointment.
Booking and capacity: A regular customer request for a time offered by the coach reserves one training place for Shared or the entire gym for Private, along with the coaching place, for 24 hours in accordance with section 20. The coach must accept and book within this period. The reservation is released if the request is declined or the deadline expires; any payment already started is checked before the reservation is released. Individual requests do not reserve a place, even if a preferred date is provided. Availability is checked again before the gym booking; only a successfully confirmed gym booking with confirmed payment entitles the coach to use the gym. Shared coaching is possible only with one customer, who occupies one of a maximum of six training places. No more than one coaching session is permitted at the same time. Coaching with two to six customers is possible only in a Private Session. Private accommodates a maximum of six customers plus one approved coach.
Access and supervision: For confirmed coaching requests made through our website, the person who submitted the request automatically receives the appointment details and activated door code by email and in their account. For bookings made directly by the coach, the coach shares the door code with their clients in good time and confidentially. If other clients attend a Private Session, the coach ensures that they also receive the necessary access information. The code may be shared only with clients attending the booked session. For Shared, this means only the one booked client. Publishing the code or sharing it with anyone else is prohibited. The coach remains present throughout the coaching session, informs their clients about the gym rules, age limits, safety and booked times, and ensures they enter and leave on time. The code is valid only during the booked slot. The coach reports access problems to Rent A Gym immediately.
Binding gym slots: Confirmed coach bookings are binding; ordinary cancellation or rescheduling and cash refunds for non-attendance are excluded. A customer's cancellation or non-attendance, unpaid customer fees, or pausing or removing a profile do not cancel a confirmed gym booking. Mandatory statutory rights remain reserved.
Medical-certificate exception with a voucher: If at least one customer cannot attend the booked appointment for medical reasons, the coach may request cancellation of the entire affected session no later than 24 hours before it begins. The request, including the booking reference and a medical certificate confirming inability to attend on the date concerned, must reach rentagymdavos@gmail.com by that deadline. After review, Rent A Gym confirms the cancellation and manually issues the coach a voucher for the full gym price actually paid, for example CHF 50 for a Shared slot. No cash refund is made under this exception. For a group, the credit also covers the entire cancelled and unused gym slot. Cancellation and voucher issuance are not automatic; Rent A Gym handles them. The coach settles the coaching service and any customer refunds separately.
Medical certificates and confidentiality: Only identification of the affected customer, the relevant date and medical confirmation of inability to attend are required; a diagnosis or medical history is not required. Unnecessary information must be redacted. The coach transmits health data only with the affected customer's express consent; alternatively, the customer may send the evidence directly to Rent A Gym with the booking reference. Rent A Gym uses the evidence exclusively to assess the exception and any related dispute and deletes it once that purpose is fulfilled and no statutory retention obligation applies.
Qualifications and insurance: The coach offers only services for which they are professionally qualified and, where applicable, legally authorised. Statements about qualifications and experience must be accurate and substantiated on request. The coach maintains professional liability cover adequate for their activities and training on third-party premises, and provides evidence on request. They ensure safe training tailored to the customer, explain the equipment, supervise exercises and stop unsafe exercises. Coach approval does not replace professional licensing or an insurance assessment.
Organisation and personal responsibility: The coach organises their coaching service independently and fulfils the tax, social insurance and business obligations applicable to their actual activities. The legal classification of the collaboration is determined by the actual circumstances and mandatory law, not solely by the designation as a coach.
Customer data and profile content: The coach uses contact details and messages received only to process and deliver the coaching requested. Advertising or other disclosure requires a separate lawful basis. Data must be treated confidentially, protected against unauthorised access and deleted once no longer required and no retention obligation applies. The coach ensures they have the right to publish their profile text, qualification details and images; other people must not be depicted without the required consent.
Safety, damage and limits of responsibility: The coach is responsible for professionally delivering their coaching service and for damage they culpably cause, in accordance with statutory rules. Rent A Gym assumes no responsibility for independent service, price or payment agreements between coach and customer. This does not exclude liability for its own breaches of duty, unlawful intent or gross negligence, or other mandatory statutory claims. Defective equipment must no longer be used; damage and safety-related incidents must be reported immediately.
Pausing and withdrawal of approval: A paused profile receives no new requests through the public coach selection. Existing obligations remain in effect. Rent A Gym may block the profile and withdraw coaching approval if information is false, required evidence is missing, or safety or usage rules are breached. Sessions already paid for that cannot take place as a result are handled individually in accordance with contractual and statutory entitlements; mandatory claims are not removed by a blanket exclusion.
